Types of Patents

Utility patents

Utility patents may be granted to anyone who invents or discovers any new and useful process, machine, article of manufacture, or composition of matter, or any new and useful improvement thereof.

Design Patents

Design patents may be granted to anyone who invents a new, original, and ornamental design for an article of manufacture.

Plant patents may be granted to anyone who invents or discovers and asexually reproduces any distinct and new variety of plant.

About Patents

The United States Patent and Trademark Office (USPTO) is an agency of the U.S. Department of Commerce. The role of the USPTO is to grant patents for the protection of inventions and to register trademarks. It serves the interests of inventors and businesses with respect to their inventions and corporate products, and service identifications. It also advises and assists the President of the United States, the Secretary of Commerce, the bureaus and offices of the Department of Commerce, and other agencies of the government in matters involving all domestic and global aspects of “intellectual property.” Through the preservation, classification, and dissemination of patent information, the Office promotes the industrial and technological progress of the nation and strengthens the economy.

 

What is a Patent?

A patent for an invention is the grant of a property right to the inventor, issued by the United States Patent and Trademark Office. Generally, the term of a new patent is 20 years from the date on which the application for the patent was filed in the United States or, in special cases, from the date an earlier related application was filed, subject to the payment of maintenance fees. U.S. patent grants are effective only within the United States, U.S. territories, and U.S. possessions. Under certain circumstances, patent term extensions or adjustments may be available.

Provisional Patent Application

The Provisional Patent Application is a process that establishes your idea or product to be yours and that you had it first. A Provisional Patent is filed with the USPTO for a Micro Entity status application. It can protect your application for up to One Year and after that you must apply for a Utility Patent or you will not be able to file and it is abandoned.

Design Patent Application

The Design Patent has to do with the particular design and how the article looks. In some cases it is preferred to the Utility advanced Patent search because it has only one claim and is typically not competing with any other Utility Patent and only with other Design Patents. The Design Patent consists of Application Paperwork – Arrangement of Specifications – Sequence Listing – Claim – Drawing(s) and other descriptions within the body of the Application. It is imperative that the Application is done in a precise arrangement or it can be disqualified and the Application must be done again.

Utility Patent Application

The Utility Patent has to do with the way an article is used and works. Both Design & Utility Patents may be obtained on an article if the invention resides both in its utility and ornamental appearance. Once again the Patent Search is imperative if you want to find exactly what is out there and what the examining Attorney will be looking for. The Utility Patent process is similar to the Design Patent process only that it can have many more claims and goes deeper into the description of the invention within the body of the Application.

Advanced Patent Search

The Advanced Patent Search is extremely important to establish the classification of your idea or product. Whether it is a Design Patent or Utility Patent you are searching for, you must look in all categories to establish the sited references the Examining Attorney will be looking for. A basic or quick search will not give you the exact information you need for your application process. The Advanced Patent Search is what they will be using and it is what you should be using as well to ensure a solid and comprehensive application process.

Drawings

Most drawings can be done by the inventor themselves. However, if more complicated drawings are needed we can certainly meet your need. If you require something very complicated we may refer you to one of our network members that will assist you for a discounted price through the Mars Rising Network Advanced patent search.
